Claim: A viral video has emerged, suggesting International Criminal Court (ICC) Judge Joanna Korner states that former Philippine President Rodrigo Duterte should be released from detention.
Fact-Checking the Claims
As of July 28, the Facebook reel featuring this video garnered significant attention, with about 95,000 views and over 2,600 reactions. In the footage, Korner is purportedly seen stating, “The court has reviewed the petition. Duterte must be released immediately. This is in accordance with the law and justice. So ordered. The ruling is clear and final.” Another similar clip from June falsely claims she said, “Duterte needs to be released immediately. Justice has been served.” The implications are huge here — not only does it misinterpret the ICC's judicial process, but it also manipulates public sentiment.
These captions misleadingly imply that an ICC judge recommends Duterte's release, prompting some social media users to express gratitude, believing the information to be authentic. Comments like, "Wow, thank you very much the Filipino people [are] very happy [for your] releasing our beloved Tatay Digong," reflect this misconception. Misinformation like this can potentially influence the perception of legal accountability, especially in a politically charged environment. If you're working in this space, staying vigilant against such narratives is critical.
The Reality
Analyzing the video's authenticity reveals a different narrative. AI detection tools, specifically Hive Detect, indicate a 96.4% likelihood of the content being AI-generated, while DetectVideo AI labels it as manipulated with a 67% probability. Such tools illustrate the challenges of distinguishing credible information from fabrications in today's digital media. Dependence on AI-generated narratives is a slippery slope, as they can easily lead to misunderstanding critical judicial decisions and mislead the public.
Further reverse image searches yielded no credible evidence supporting the validity of the statements attributed to Judge Korner, emphasizing the necessity for thorough fact-checking. This practice shouldn't just fall upon journalists; social media platforms must also combat the proliferation of misinformation on their sites. Additionally, a lack of official news releases or statements from the ICC confirming that Korner called for Duterte's release underscores the video's falsehood. Previously, similar AI-generated narratives regarding Korner's comments about Duterte have been debunked by Rappler following a status conference about his case in May. Each instance reinforces the need for media literacy among consumers.
Duterte's Detention Status
It's also essential to highlight that Duterte's requests for interim release have been consistently denied by the ICC. The court reaffirmed in May that he will remain detained for another year as charges were confirmed in April. As noted by the chamber, the confirmation of charges generally increases the risk of a defendant absconding, thereby justifying continued detention rather than release. This underscores a broader truth about judicial processes in cases involving high-profile defendants: public sentiment or political pressure won’t alter legal protocols.
Duterte is facing three counts of crimes against humanity related to his alleged participation in extrajudicial killings during his administration's war on drugs and the activities of the Davao Death Squad. His ICC trial is scheduled to begin on November 30, 2026. This timeline may appear distant, but it also hints at the extensive procedures involved in international law, often lengthy and complex, requiring meticulous examination of evidence and legal arguments.
Previous Misleading Claims
Rappler has addressed similar false claims about Duterte's detention in the past, including:
- FACT CHECK: Duterte remains detained; VP Sara not at ICC to ‘pick up’ her father
- FACT CHECK: Duterte not set to be released amid US push to dismantle ICC
- FACT CHECK: ICC did not junk Duterte’s case
- FACT CHECK: ICC did not say evidence vs Duterte is insufficient
- FACT CHECK: Video of ICC judge saying Duterte should not be imprisoned is AI-generated
- FACT CHECK: Photos of Duterte being assisted in ICC courtroom are AI-generated
Implications and Future Outlook
This situation raises important questions about the balance between judicial integrity and public perception. The spread of misinformation about legal proceedings can have profound implications for justice, particularly when emotions run high, as they do in Duterte's case. As misinformation continues to sprout in the digital age, the need for fact-checking becomes more pronounced.
Moreover, the reliance on AI technologies for content creation complicates the landscape; they can produce believable narratives that manipulate realities. Awareness and education around these technologies’ limitations are essential if we’re going to navigate the complexities of modern information sharing.
As the trial approaches, expect tensions to escalate, and public interest to intensify. Misinformation will likely resurface, making the role of responsible journalism and social media platforms even more significant. (And this is the part most people overlook: accountability is a two-way street.) Vigilance against falsehoods will be paramount as this high-profile case unfolds.
